need help ASAP I have a support order only problem is my ex continues to jump from company to company(construction) in order to not get caught. I have had a wage garnishments but they do me no good because it will have the name of a patricular company on it. He has decided how much he wants to pay and when. It is not even close to what the judge ordered. Because of this I am behind in every bill and can barely make ends meet. I work over 50 hours a week and feel I may need to take a night job just to keep providing for the . My question is... does anyone know who I can turn to for help. The state or any agencies can take up to 6 months. He would have moved on to another job by then. Does anyone know an attorney that can work with me on this, and can start without the $3000 up front fee? Please help

Yes, they will. But there is only they can do. Some CPs want the DCSS to perform magic tricks like garnish undeclared cash income or intercept tax returns from people who never file their taxes or force someone to get a legitimate job. If some NCP does not want to pay, there is nothing that any DCSS can do to make him pay. They can do all sorts of things to compell him but they cannot make him. I work for a CA DCSS.

Sister, I hate to break it to you, but there's not a living soul that can 'MAKE' his pay. He doesn't mind working for cash and jumping job without benefits or pension...He's not going to lose any sleep when the (in a few years) suspend his driver's license...and he'll justl eave the state when a warrent gets issued for not paying cuz noone's going to bother to go after him...he won't care that he'll never own anything - so you can't find him or take it...and he won't care that there's a fat lien on his credit report since he'll have some other sucker-gal to support him eventally. You're on your own. DO stay on cs enforcement and do whatever you can. but don't expect a dime. But don't waste valuable time, money, and energy fighting for some thing you may never get. Be strong for your children and show them that a true loving parent takes care of their children. You'll only hurtthem by dwelling on the deadbeat parent. good luck to ya!

break it to me He does have the sucker gal and they live with her family. He has been able to purchase x new cars this year and they are looking to buy a house by the end of the year. I am working on not getting evicted and he laughs about the whole thing. I am working on "taking the high road" and I know my kids see how hard I work to support them. Thanks for your reply

You can at least get a judgment He can be put in jail if he doesn't pay up for the short term. You don't need an atty for this. I don't know why these people are telling you there is nothing you can do. If he's not paying anyway, he might as well be in jail. It might help him wise up and later he might be able to support his child if he ever wises up. The CS people will be able to help you, but the process is slow. You will have to substantialy downgrade your standard of living even if it is bad already and pretend you don't have any child support. Working x hrs a week is certainly not good for child. It's a tough situation. If you get the judgment against him, it will be good until paid, I believe, so one day when he grows up and buys a house or something, you'll get all the back money and you and child will eventually benefit. Hopefully he is young and doesn't get killed.

How does jail get he the money? I am not saying what he is doing is right- it is not. I am not saying she should stop trying to get CS thorugh the courts either - she should. I am saying what do-so said. Count on getting nothing, then be surpised if you actually do. I know soeone who did not pay his support because he owned his own business and was afraid that he would lose it. His wife filed and they had a hearing. The courts let himn off, feeling sorry for HIM, of all things. SO, you NEVER know what a judge will finally do either.... Good luck.

jail is not for getting CS Jail is punishment for not abiding by a court order. If he makes a decision to disregard a court order made by a United States judge- then he needs to pay the consequences. That's why he should go to jail. Same sort of thing as why people buying or selling drugs are sent to jail- not to help them quit using but to pay the consequences for breaking the law.

It might get her money Through his reform, if that happens. THe money would come much later, probably when the kid is all grown up. People are usually not derelict their whole lives. They usually end up buying a house. Once he does that, and he sells it, she can put a lien on it. At least in the end his could benefit. Again, not saying that it helps her now.

CA laws regarding contempt of a order are rather lax. It is very rare that an NCP goes to jail for contempt, very rare.

CS can only much.... xst off if they put a judgement on him, thats not a big deal someone that doesnt care about their credit and after xyrs he can write the creditors and have it removed. Also this doesnt have to be paid before buying a house. I do mortgage loans for a HUGE Bank. and we NEVER make anyone pay support off no matter how behind they are. the reason is the CS is so behind and has poor records and never update even if someone is paying. so CS is not counted as a regualr creditor. as of locking him up, good luck with that. all he has to do is show up in court with x bucks and walks. no matter how far behind he is. you can get CS to issue a show cause to bring him in front of the judge, but again if he shows up with even x bucks he walks! you will have to do the paper work for CS, they will guide you, and you will have to give them all his info as in home address, work address, etc. they wont do that. it sucks, good luck to you. i think you may want to look at living without the support and adjust you life. andday a check will be in the mail. move in with family and friends, take evening classes, its hard but women have been doing it alone for yrs.
